Terms of Service

Please read these Terms of Service ("Terms") carefully before using any website or service operated by ZeldaHosting LLC ("ZeldaHosting", "we", "us", or "our"), including zeldahosting.com and Jaxol. By accessing or using our services you agree to be bound by these Terms.

1. Acceptance of terms

By creating an account or otherwise using ZeldaHosting services, you confirm that you are at least 18 years old, have the legal authority to enter into these Terms, and agree to comply with them. If you are using our services on behalf of an organization, you represent that you have authority to bind that organization.

2. Services

ZeldaHosting provides cloud infrastructure, domain intelligence (Jaxol), and related SaaS tools. We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice. We will not be liable for any modification, suspension, or discontinuation of services.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at security@zeldahosting.com if you suspect unauthorized access. We may terminate or suspend accounts that violate these Terms.

4. Acceptable use

You agree not to use ZeldaHosting services to:

  • Violate any applicable law or regulation.
  • Infringe the intellectual property rights of any third party.
  • Transmit malware, spam, or any harmful or disruptive content.
  • Attempt to gain unauthorized access to any system, network, or account.
  • Scrape, crawl, or extract data from our services in ways that exceed normal usage or circumvent rate limits.
  • Resell or redistribute access to our services without prior written authorization.
  • Engage in activity that places an unreasonable load on our infrastructure.

We reserve the right to suspend or terminate access to any user who violates these restrictions, without prior notice.

5. Payments and refunds

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except where required by law or explicitly stated in a separate agreement. We may change pricing with 30 days' written notice. Continued use of paid services after a price change constitutes acceptance.

6. Intellectual property

ZeldaHosting and its licensors retain all rights, title, and interest in our services, software, trademarks, and content. Nothing in these Terms grants you ownership of any ZeldaHosting intellectual property. You retain ownership of data and content you submit to our services, and you grant us a limited license to use that data solely to provide the services.

7. Confidentiality

Each party may receive non-public information from the other. Each party agrees to keep such information confidential and not to disclose it to third parties without prior written consent, except as required by law.

8. Disclaimer of warranties

Our services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the services will be uninterrupted, error-free, or free of harmful components.

9. Limitation of liability

To the maximum extent permitted by law, ZeldaHosting and its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services. Our total aggregate liability to you for any claim arising from these Terms or the services will not exceed the greater of (a) the fees you paid to ZeldaHosting in the 12 months preceding the claim or (b) USD $100.

10. Indemnification

You agree to indemnify and hold harmless ZeldaHosting and its affiliates from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the services, your violation of these Terms, or your infringement of any third-party rights.

11. Governing law and disputes

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles. Any dispute arising from these Terms or the services shall be resolved by binding arbitration under the rules of the American Arbitration Association, conducted in English. You waive any right to participate in a class-action lawsuit or class-wide arbitration.

12. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website at least 14 days before the changes take effect. Continued use of our services after the effective date constitutes acceptance of the revised Terms.
